"We Will Not Become An Obstacle" The Supreme Court Will Open The Competition For Members Of The Constitutional Court
The Supreme Court is considering opening the competition for the three members of the Constitutional Court who according to the Law will be selected by them.
Deputy President of the Supreme Court, Sokol Sadushi in a statement to the media said that this is done in order for the Supreme Court not to become an obstacle to the establishment of the Constitutional Court.
"As far as the issue related to the completion of the Constitutional Court is concerned, of course the completion of the Constitutional Court is probably one of the most delicate and long-awaited issues on our part, especially on my part, even for the fate that I was part of. I am still very interested in that Court to become that Court an hour ago. "
At the moment, the Supreme Court does not have a quorum for the selection of judges, however Sadushi expressed confidence that with the pace that the High Judicial Council will follow that in the middle of next year will make possible a quorum of the High Court.
"But of course we have to take into account some definitions that the law has made where it requires a necessary quorum for the High Court and it is understandable that this quorum required by law of three quarters, ie requires 15 judges of the High Court who to have the opportunity to convene and decide on the appointment of three judges of the Constitutional Court, who are part of the judiciary."
"We thought that in parallel with the formation of the Supreme Court, we should start thinking about the opening of the competition, which has a positive and negative element.
The opening of the competition gives hope that the Constitutional Court will be created but the opening of the competition makes it impossible to make a decision due to the limited number that the High Court has, but hoping with the pace that the High Judicial Council will follow I am confident that the middle Next year will make a quorum of the Supreme Court possible."
Sadushi believes that 2021 could be the year of the Supreme Court both in its format and the fact that it will play the role of setting up the Constitutional Court in full.
