Ardian Dvorani Demands Return To JAC
Former Supreme Court Judge Ardian Dvorani is seeking hisreturn as a member of the Judicial Appointments Council, after the HJC declaredthe end of his term at the request of the President of the Republic.
In a letter sent to the current chairwoman of JAC,Vitore Tusha, Dvorani states that the end of his term in the Supreme Court doesnot hinder him in his capacity as a member of JAC.
Announcing that he will not attend the meeting on August21, until the matter is clarified, Dovrani requests that the JudicialAppointments Council comment on his status as a member.
Dvorani, who is already a judge of the AdministrativeAppeal, points out the gap in the laws and the constitution regarding thisissue, emphasizing that the current legal basis does not have any concrete andexpress regulation, regarding the cases when alternate members of KED, duringthe calendar year of the mandate, they change the function they held at thetime of the lottery from which they were elected.
For this reason, Dvorani states that the change of hisduty from a judge in the High Court to a member of the Administrative Appeal,does not bring any consequences in his 1-year term as a member of JAC until theend of this year.
