Criteria "Without Criteria", PPA Finds Violations In Tenders: They Have Excessive Conditions

The number of employees and certificates are the criteria that have led to the disqualification of companies from tenders. PPA has deemed them excessive, while for the violations found, 62 employees have been fined and have requested disciplinary action for 57 others.

But now the Public Prosecution Agency itself has raised concerns about the proceedings.

62 employees were fined for violations during the period 2018-2020 and 57 others were disciplined.

According to the document, there are 26 typologies of violations that are most often found in procurement.

The number of employees, technical capacities, licenses, certificates, etc. that lead to disqualification of most companies are money as elements that exclude competing entities, so it is proposed to avoid them.

The PPA finds that an unsubstantiated number of employees is required when it is not necessary, thus limiting the participation of small companies in the competition, while the obligation to declare a conflict of interest between the contracting authority and the party involved in the process does not apply.
